Are Alcopops beer or hard-liquor?

You can now find Alcopops like FourLoko, Joose, and Smirnoff Ice in the beer section of just about any gas station around. But are they beer or hard-liquor?

Some Alcopops contain or used to contain "energy" (caffeine, guarana, etc.). Recent legislation has made it nearly impossible to produce or distribute alcoholic energy drinks in the US due to health concerns and under-age abuse.

Most Alcopops are actually malt beverages, which is commonly considered beer. They are sold next to beer, come in cans like beer, but the alcohol percentages are like high-gravity 40-oz drinks, sometimes more.
